Understanding Copyrights:
Copyright law secures for the creator, of a creative effort, the exclusive right to control who can make copies, or who can make works derived from the original work. There are a lot of subtleties and international variations, but that's the basic idea. If Custom Design Works creates something, and it fits the definition of a creative work (intellectual property), we get to control who can make copies of it and how they make copies. Custom Design Works can also sell or licence this right to the customer for a fee.
 

Logo and Copyright Fees:
Logos and any artwork are designed on an hourly basis, plus copyright fees. If copyrights are not purchased, then that logo/artwork remains the property of Custom Design Works, but the hourly design fee is still the responsibility of the client.

Design Fees and File Fees:
All graphics are designed on an hourly basis. ($75.00 per hour). Minimum charge of $15.00. Hourly fees are for the "graphic design" of your product, not for the ownership or copyrights of the actual professional design files. If "professional graphic design files" are needed by the client, they must be purchased separately, over and above the design fee price.

File types such as .pdf, .tif, or .jpg are included in the price of your design fee as well as one original print out in color or black and white.

Late Fees:
Payment is due upon receipt. If payment is not received upon receipt a 1.5% interest charge is first made when a debt becomes overdue. An additional 1.5% charge will be made on the first day of every following calendar month until the debt and interest are paid in full.

If necessary, Custom Design Works reserves the right to use a collection agency to collect overdue debt. If a collection agency is used, the debtor will be responsible for ALL collection agency fees which could be 25 to 30% of the total debt.

  
 

TERMS & CONDITIONS

Sample Copyright Areement for Client with Custom Design Works: All proofs, logos, and/or designs are property of CUSTOM DESIGN WORKS and are released to the client for client approval only. They are not to be shown to any competition for consideration, reproduction, or improvement of any kind without permission from CUSTOM DESIGN WORKS.

In the event of any cancellation by the client, CUSTOM DESIGN WORKS shall retain all original artwork and shall be paid by the client based upon the work completed and expenses incurred.

CUSTOM DESIGN WORKS releases copyright to said client if client agrees to pay for copyright of FINAL logo and/or FINAL design. All other designs and concepts resulting from the design process shall remain the exclusive copyright of CUSTOM DESIGN WORKS. If copyright is not purchased, all proofs, logos and/or designs remain property of CUSTOM DESIGN WORKS and Client must obtain permission to use the proofs, logos and/or design in any form or reproduction thereof.

When a financial agreement is reached and full payment is received, CUSTOM DESIGN WORKS will release copyright of the logo and/or designs to said client.

CUSTOM DESIGN WORKS retains the right to utilize ANY artwork, designs, edits, revisions and work product from THE PROJECT in advertising, promotion and other marketing materials.

Due to the complexities of international copyright and logo trademark law, Custom Design Works will not be held liable should THE CLIENT be found to be infringing on an already existing copyright or trademarks or service mark relating to the project icon, project name, description or service. THE CLIENT should conduct a copyright and/or trademark search.
